CCD Position Statement on student access to AT when policies limit access to tech
Federal disability and education civil rights laws protect, promote, and support access to assistive technology (AT), auxiliary aids, services, accommodations, and other supports for students with disabilities in PreK-16 schools.i Students who qualify under the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973 (504) and/or the Americans with Disabilities Act (ADA) must be provided the AT devices, auxiliary aids, services, reasonable accommodation, and other supports necessary to have meaningful access and engagement in education.

The purpose of this letter is to request that the Administration take all necessary and sufficient steps to ensure that federal agencies are held accountable for achieving digital accessibility (an outcome that should have been achieved years ago). To accomplish this goal, we ask that there be real consequences for those agencies that continue to renege on their legal obligations under Section 508 of the Rehabilitation Act and fail to meet the clear expectations in E.O. 14035 to ensure digital accessibility.

At least 1 in 4 people in the U.S. has a disability (more than 61 million). While 99% of public buses are equipped with ramps, significant barriers to accessible, affordable transportation remain across modes. Many people with disabilities are unable to obtain a driver’s license or cannot afford to purchase both a vehicle and the retrofitted adaptations to make it accessible.

The Importance of Web Accessibility and Inclusive Design
The Americans with Disabilities Act (ADA) guarantees that people with disabilities have the same opportunities as everyone else to participate in activities across all areas of life. While many understand the requirements of accessibility for physical spaces, such as wheelchair ramps to enter buildings, this mandate extends to virtual spaces as well. As more and more of our daily lives are spent engaging with the Internet and other digital content, it is critical to ensure that information hosted online and in digital format (including via websites, mobile applications, online systems, and all forms of information and communication technology - ICT) remains fully accessible to people with disabilities.

Assistive Technology and Section 508 of the Rehabilitation Act
In 1998, Congress amended the Rehabilitation Act of 1973 (29 U.S.C. 794d) to require federal agencies to make their electronic and information technology public content accessible to people with disabilities in Section 508. Inaccessible technology interferes with an individual's ability to obtain and use information quickly and easily. The requirements of Section 508 were put in place to eliminate barriers in information technology, to make available new opportunities for people with disabilities and to encourage development of technologies that will help achieve these goals.

K-12 Virtual Instruction Accessibility
Virtual Instruction Access Barriers and Legal Actions. There are many instances of legal action around online accessibility issues in both the higher education and K-12 realm. A higher education example is the settlement agreement with EdX that included making the platform, mobile application and learning content conform with WCAG access standards, mandatory accessibility training for content developers, and hiring an accessibility evaluator.
